1 GENERAL

Nordic-duke.com an online store maintained by Simsport Oy, Jousitie 6, 20780 KAARINA, business ID 1025069-5 (“Duke” or “us”).

These Terms & Conditions apply to the customer’s (“Customer” or “you”) use of the Nordicduke.com website (the “Service”) and to all orders placed through the Service.

You must accept these Terms & Conditions in order to place an order through the Service. By accepting these Terms & Conditions, you agree to be bound by them in their entirety.

Orders are subject to the Terms & Conditions in force at the time of the order available at duke.fit.com. Duke reserves the right to update the Terms & Conditions without prior notice. The Customer will be informed of the current Terms & Conditions as the Customer purchases products through the Service. For clarity, consumer-trade complies with the current Finnish and European Union consumer protection legislation. These Terms & Conditions do not in any way limit a consumer’ rights under the mandatory provisions of the Finnish Consumer Protection Act. The trade between corporate customers and Duke is governed by the Finnish Trade Act, unless otherwise provided in these Terms of Agreement.

2 ORDERING FROM NORDIC-DUKE.COM

The agreement between Nordic Duke and the Customer is deemed concluded when Nordic Duke has confirmed the Customer’s order placed through the Service, and the Customer has received an order confirmation from Nordic Duke by email.

Nordic Duke sells products and services for over 18 years old private persons (hereinafter referred to as ’private customers'). Children under 18 years old are permitted to place orders only with the consent of a guardian. Commodities are also sold to corporate and public administration customers (hereinafter referred to as 'corporate customers') who acquire the merchandise for professional use.

The customer is reguired to provide us needed contact and personal data upon order. Private customers must provide at minium their name, address, phone number and email-adress. Corporate customers must provide a name, phone number and email of a corporate contact person, business ID, address, appropriate phone numbers and in some cases a billing adress. Nordic Duke may reject the Customer’s order, cancel the agreement or change the terms thereof, if the Customer has provided an incorrect identity number or other erroneous information.

The product’s price is the price indicated in the Service at the time of order. If the order is modified the price will be price indicated in the Service at the time of the modification. All prices at the Service are announced in euros. and their include VAT. Delivery costs are determined by the chosen delivery method and will be added to the product’s price at the checkout.  For international orders, please note that the price does not include any duty or tax fees that you may incur in your country. You may be required to pay duty, VAT, or customs charges on your purchase. The customer is fully responsible for paying these taxes and charges.

The delivery time indicated in the order confirmation is estimated by our product and delivery service suppliers. Nordic Duke is not resposible for delays that may occur depending on sudden changes that affect the delivery possibilities.

In the event a product is temporarily out of stock, it cannot be replaced by another product or delivered as subsequent delivery. In such an event Dordic Duke will refund the product’s price to the Customer automatically. Nordic Duke reserves the right to restrict the sale of products in exceptionally large batches.

Nordic Duke is not liable to compensate the Customer or to fulfill its delivery obligation if the products are no longer available or in case of errors in the Service (e.g. errors in product descriptions), erroneous prices or information regarding the stock situation. Nordic Duke Nordic is entitled to correct any such errors and to change or update any information in the Service at any time. Nordic Duke has the right to cancel an order in case the price indicated at the online store clearly differs from the market price due to a pricing error.

Professional products are sold to consumers only under the rules of the acquisition. Installing, commissioning and using products requires professional expertise in their field. Professional products are specifically labelled in our online store.

Products and services are always sold as they are. This refers to trade in used discount products. (Consumer Protection Act, 5. Chapter, Section 14)

3 DELIVERY OPTIONS

Currently we offer domestic delivery to Finland. Orders to Finland typically process and ship within 2–5 business days from our warehouse in Finland. You will receive an email confirmation when your order is shipped.

Nordic Duke reserves the right to change the method of delivery after the confirmation of the order. The customer will not be charged for any additional costs due to changes in the method of delivery.

When the package is to be collected from a certain point of delivery, the Customer must collect it within the time period specified in the notice of arrival. If the package is not collected, Nordic Duke has the right to charge the Customer for direct costs incurred from the handling of the uncollected package.

Upon collection of the delivery, please check the condition of the package for possible damages and read the instructions and conditions of the product before use. In case the package has been damaged during the transportation by the transport company, please report the damage immediately at the point of collection to the delivery supplier. After making the damage report, remember to contact us to agree on a new delivery.

Nordic Duke is not obligated to reserve other products of an order to the customer if the availability of one product from it is poor or its delivery is delayed for reasons beyond Nordic Duke's control. In such case, the customer can alternatively accept either the backorder of the delayed product or the cancellation of the order. Delivery costs for backorders will be charged normally. The products on the order will be reserved for a maximum of 7 days, after which the order will be cancelled unless the customer has agreed to the backorder in accordance with Nordic Duke's terms and conditions.

4 PAYMENT OPTIONS

You may choose from the available payment options specified below:

  • Credit and debit card
  • Klarna
  • Payment by cash on delivery is not an available option.

Payment service provider

Paytrail Oyj (2122839-7) acts as the payment service provider in cooperation with Finnish banks and credit institutions. Paytrail Plc appears as the payee on a bank statement or card invoice and forwards the payment to the merchant. Paytrail Plc is licensed by a payment institution. In the event of a complaint, please contact the supplier of the product as a matter of priority.

5 RETURN AND REFUND POLICY

Private customers may return certain unused products with in 14 days from receiving the product. The customer must inform us of this through the contact form available https://www.nordic-duke.com/contactus before returing the product. Customer Service will provide return instructions as well as a product return form. The customer is obliged to present a purchase certificate, receipt or other certificate of the date of purchase at the time of return or when informing us about the defect in the goods.

The notification period of the withdrawal and product return is 14 days after receiving the shipment. The product(s) must be returned within 14 days from the date when you informed us of your intention to withdraw from the contract.

The limitations for the right of withdrawal under Chapter 6 Section 16 of the Finnish Consumer Protection Act apply. The right of withdrawal does not apply in the event a sealed product that cannot be returned due to hygiene reasons has been opened, the product is used or the product packaging has been opened in an uncareful manner and is therefore broken. Products that are specially manufactured, ordered or modified at the buyer's request, cannot be returned and the right to withdraw from a contract does not apply after the work to deliver the order has been started or the purchase order for the product to be purchased for the customer has been completed.

The products must be returned properly packed, in good condition and in th original box and/or packaging. Nordic Duke will pay the return costs in Finland, if the product(s) are returned within the 14 days period. Please note that in case you return the product(s) from another country, you must return the product(s) on your own cost.

The Customer is responsible for the product’s condition after delivery and during the return transport. If the returned product has been used in violation of the duty of care belonging to the Customer, Nordic Duke may charge the Customer for the product’s depreciation in value up to the full price of the product, as well as the return costs.

All corporate customer returns must always be agreed with customer service before returning. The returned product must be unused and in an unopened sales package. For more information about the return, please contact the [email protected]. The right of return does not apply to products over EUR 1,000, orders worth more than EUR 2,000, or products ordered/modified separately for the customer. In addition, in the case of a service ordered for a customer or other separate service, the corporate customer does not have the right to cancel the order after the it has logged into the Nordic Duke's system.

In case the product received by you is broken or defective, please read the section 7 Defects, warranty and Support below.

6 RETURN OF PAYMENTS

We will return all payments received from you (except delivery costs and additional costs resulting from you choosing a delivery method different from the most affordable standard method offered by us) without undue delay and at the latest after 14 days from the receipt of the notice of withdrawal. We may, however, refrain from returning the payments until we have received and verified the defects of the products.

Please store all the documents related to the return carefully until you have received confirmation on the receipt of the returned products from us.

The payments will be returned by using the same payment method you have used in the original transaction. You will not incur any costs due to the return of the payments.

7 DEFECTS, WARRANTY AND SUPPORT

In case the product received by you is broken or defective or you need support with it, please contact us without delay at https://www.nordicduke.com/contactus or via email [email protected]. All reclamation requests must be submitted in written form. Our Customer Service will provide further instructions and support.

Nordic Duke is responsible for the statutory liability for product defects under the Finnish Consumer Protection law. Unless otherwise provided by mandatory law, Nordic Duke’s maximum liability is limited to the price of the product ordered and deemed defective.

The warranty of our products is determined in accordance with the warranty terms specified by the product manufacturer. The Customer is obligated to familiarize him-/herself with the warranty terms and conditions supplied with the product before using the product. The warranty terms can be found in the product instructions, in a separate warranty form or at the web address indicated by the manufacturer. Nordic Duke reserves the right to verify the informed product defects.

The product warranty service location depends on the product and is determined in accordance with the manufacturer’s warranty terms. The warranty service time depends on the warranty dervice location.

Nordic Duke is not liable for damage caused by the buyer's actions. The full cost of a service and maintainance visit (possible costs of the maintenance company, the handling costs of Nordic Duke and the logistical costs) will be charged to the customer if the product has been delivered clearly unduly to warranty service. The right to check the nature and quality of the defect in the product remains with Nordic Duke even in case of sales contract withdraw.

Physically opening or modification of the product terminates the warranty and the liability for errors specified by law, unless otherwise stated by the manufacturer or us.

We will store products for three (3) months after the customer has been notified of the completion of the warranty service/maintenance. The product is then recycled, as stated in the law on the trader's right to sell an uncollected item.

DIVISION OF RESPOSIBILITIES IN CORPORATE CUSTOMER CONTRACTS

Products and services are always sold as they are. Nordic Duke shall not be liable for any indirect or direct costs incurred as a result of the error and/or use of the products or services, nor for any loss of income. The liability of Nordic Duke is always limited to the content of these terms and conditions. The liability for product defects is limited to any refund of the purchase price minus the utility.

The warranty period for a product purchased for business purposes is determined in accordance with the manufacturer's warranty terms, and the expiry of the warranty period terminates the liability of the Nordic Duke. Physically opening the product to modify the device terminates the warranty and the seller's liability, unless otherwise specified by the manufacturer.

Nordic Duke reserves the right to direct corporate customers to deal directly with the manufacturer or a service center authorised by the manufacturer. Further information on maintenance can be requested from [email protected].

Regarding  warranty maintenance and repair service, We will store the products for three (3) months after the customer has been notified of the completion of the service/work. After this time the product is recycled.

Nordic Duke is not obliged to fulfil a contract if it encounters force majeure that it cannot reasonably overcome. Nordic Duke is not obligated to compensate the customer for any damage or costs incurred by the customer in cases of force majeure and is entitled to terminate the contract.

When submitting an order and/or request for quotation, the customer unquestionably accepts these terms and conditions of Nordic Duke. Any contract terms used by the customer will not be complied with in the event of a conflict with the contract terms of the Nordic Duke.

8 PROMOTIONAL DISCOUNTS AND SPECIAL OFFERS

All promotional discounts and special offers at duke.fit.com are subject to special terms and conditions available from time to time at the promotion campaign page at nordicdude.com (duke.fit).

All promotional discounts and special offers are valid for a limited time. Nordic Duke reserves the right, at any time in its discretion, to cancel any promotional discount or special offer before its expiry.

Promotional discounts and special offers may be limited to specific products featured at nordic-duke.com. Eligible products are subject to change in Nordic Duke’s sole discretion.

Promotional discounts may be redeemed only once, and only one promotional discount may be redeemed per order. Promotional discounts must be redeemed before the order is confirmed and cannot be applied to the purchase after Nordic Duke has sent the order confirmation.

Promotional discounts are non-transferable, not for resale, and not redeemable for cash.

9 FORCE MAJEURE

Nordic Duke is not responsible for delays or damages caused by an event of force majeure, meaning an unforeseeable event or change in circumstances that is beyond Nordic Duke’s reasonable control, such as delays caused by the actions of a logistics operator. Nordic Duke will inform the Customer of the force majeure event without undue delay.

10 SERVICE AND MATERIALS AT NORDIC-DUKE.COM

Nordic Duke retains all rights to the information and materials displayed in the Service. Copying materials (text, pictures, prices etc.) from the Service without permission is not allowed. The materials are intended only for the purposes of reviewing Nordic Duke’s products and making a purchase decision. In particular the information displayed or any images in the Service cannot be collected to be used in other (online) service or otherwise.

11 DISPUTE RESOLUTION

All disagreements and disputes shall primarily be resolved through negotiations. Any claim or cause of action you may have with respect to Nordic Duke or the website or the Services must be commenced within one (1) year after the claim or cause of action arose. In case a disagreement arising from the contract cannot be resolved through negotiations between the parties, the Customer may take the issue to the Finnish Consumer Disputes Board (http://www.kuluttajariita.fi) or a similar dispute resolution body, where applicable.

Check for your local dispute resolution body online here. You may also use the Online Dispute Resolution platform available at http://ec.europa.eu/odr. Proxy costs are not reimbursed because the Consumer Advice and Consumer Disputes Board provides free assistance in resolving disputes.
